JACKSONVILLE —
Horacio Gonzalez, former Jacksonville man, was found guilty of aggravated sexual assault of a child May 17. It happened in the Cherokee County Second Judicial District Court with Judge Dwight Phifer presiding.
Gonzalez was sentenced to 30 years confinement in the Texas Department of Criminal Justice, Institutional Division. The state was represented at trial by First Assistant Cherokee County District Attorney Rachel Patton.
District Attorney officials said Gonzalez was accused of digitally penetrating a girl under 14 years old back in July, 2008.
Richard Mayhan represented Gonzalez.
“There were two potential findings other than ‘not guilty’,” Mayhan said. “One was aggravated sexual assault of a child and the other was indecency with a child.”
Mayhan said his desire was for the court to deliver a ruling of indecency with a child.
He added if an appeal is made he will not be Gonzalez’s attorney through the process.
